REALDEALPOKER TERMS & CONDITIONS

1. Introduction

This End User Agreement (referred to herein as the “Agreement”) is a legally binding Agreement between you (referred to herein as the "User" or "you") and Real Deal Poker (referred to herein as “RDP”, “us” or “we”) which owns and operates the Internet site which can be found at www.RealDealPoker.com (referred to herein as the “Site”). In addition to the terms and conditions of this Agreement, please review our Privacy Policy, Poker Game Rules, House Rules and any other rules, policies and terms and conditions relating to the games and promotions available on the Site as posted from time to time, which are incorporated herein by reference. Please read the Agreement carefully and make sure you fully understand its contents. If you do not agree with any of the terms of the agreement then you should not download, install or otherwise use the Real Deal Poker Software (referred to herein as the “Software) open a real money poker account (referred to herein as the “Account”) or play Real Deal Poker Real money or Play money games and tournaments (referred to herein as the "Games").

2. Legal Requirements

The Software is being licensed to you by RDP for your private personal use only. The Software is not for use by:
- Individuals under 18 years of age
- Individuals under the legal age of majority in their jurisdiction
- Individuals connecting to the Software, from jurisdictions in which online gambling has been made illegal. It is the user’s responsibility to ensure that by using the Software, they do not breach any laws in their jurisdiction
Please note that individuals residing in the following countries are not able to use the Software:
- Hong Kong
- China
- Turkey
- United States of America
- US Virgin Islands
- American Samoa
- US Minor Outlying Territories
- Guam
- Northern Marianna Islands
We reserve the right to immediately close accounts registered by individuals residing in these countries.

3. We also reserve the right to request proof of residence and identity in order to ensure that parts 2.1 and 2.2 of this Agreement are not violated in any way. We further reserve the right to suspend or cancel your account and exclude you from using the Software, if satisfactory proof of age and/or residence is not provided.

4. Grant of License

Subject to the terms and conditions contained herein, RDP grants the User a non-exclusive, personal, non-transferable right to install and use the Software in order to access the Real Deal Poker Servers (referred to herein as the “Servers”) and play the Games.

5. No Warranties

The Software, the Site and the games are provided to you "AS IS". We disclaim any and all warranties, expressed or implied, in connection with the Site, the Software and the Games. Furthermore, we provide you with no warranty or representation whatsoever regarding their quality, fitness for purpose, completeness or accuracy. Regardless of our efforts to provide you with a service of the highest quality, we make no warranty that the Site and the Servers will be uninterrupted, timely or error-free, that defects will be corrected, or that the services found therein shall be free from viruses or bugs. The use of the Site, Software and Games is entirely at the User’s risk.

6. Your Responsibilities

Prior to the use of the Software and Games, you understand and agree that:

You are fully responsible for all taxes, fees and other costs incidental to and arising from winnings resulting from the use of the Software and Games
It is your responsibility to (inform us of any changes to your) / (update) registration details
You shall provide us with all information requested by us, necessary for the operation of your Account, including but not limited to, proof of identity, proof of address, utility bills, bank details, bank statements, credit card details and bank references.
You accept that you are solely responsible for the supply and maintenance of all of the computer equipment and telecommunications networks and internet access services that you need to use in order to access the Site, Software, Account and the Games. We will not be liable in any way whatsoever for any loss caused to you by the internet or any telecommunication service provider which you may be using in order to access the Site, Software, Account and Games.
If you win a seat or package for a live event, you agree to wear Real Real Poker gear exclusively. If you do not wear Real Deal Poker gear, we reserve the right to rescind the prize package.

7. Your Warranties and Representations

You warrant and represent that:

Accessing and using the Software and Games is legal from your jurisdiction and you are not residing in any of the countries mentioned in part 2.2
You are acting on your own behalf
You are not restricted by limited legal capacity
You are not classified as a compulsive gambler
By using the Software and playing the Games, there is a risk of losing money and RDP has no responsibility to you for any such loss

8. Prohibited Uses

Software modification
You may not attempt to modify, decompile, reverse-engineer or disassemble the Software in any way. You also understand that the Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.
Personal Use
The Software is intended solely for your personal use. You are only allowed to wager for your own personal entertainment. Under no circumstances shall a User be permitted to use the Software and his/her Account with RDP for any purpose other than for playing the Games. You understand and agree that Commercial use of the Software is strictly forbidden without express permission from Real Deal Poker.

You may only have one Account with Real Deal Poker and you will not allow any other person(s) to use the Software through your Account. The violation of this rule, will lead to an Account review, which may result in the suspension or termination of all your Accounts.

Before playing at RDP, you are responsible to make sure that use of the Software and Games, is not against the law in your jurisdiction.
Fraud and Collusion
In the event that we suspect fraud or improper, unlawful, dishonest, or fraudulent activity on your part while using the Software and/or the Games, including without limitation the use of a stolen credit card or fraudulent chargeback or money laundering, we are entitled to take the necessary actions, as we see fit, including but not limited to the suspension and/or closure of your Account, seizing the remaining balance, disclosing all relevant information including the User’s identity to financial institutions, authorities and any other person or entity that has the legal right to such information and/or taking legal action against you.

Collusion between users, by any method including but not limited to chip dumping, sharing hole cards, allowing multiple users using the same Account, sharing information about a hand before it finishes, is strictly prohibited. Among other measures, we reserve the right to restrict seating and/or to prevent Users from playing at a particular poker table or in a tournament, including restricting two or more Users from playing together at the same table or the same tournament. Collusion between users is considered by RDP as a breach of this Agreement and RDP has the right to take necessary actions as it sees fit, including but not limited to the immediate termination of a User’s account and the forfeiture of the Account balance.
1.Prohibited Software and Bots
Any software (other than the “Software) and/or database use in relation to the RDP Software and Games, is strictly forbidden. At RDP, a user should not have an unfair advantage over other users and any information he/she has access to, should be the one he/she personally collected through his/her experience and observations through his/her own Game play.

The use of any kind of artificial intelligence, including but not limited to Robots (Bots) is strictly prohibited in connection to the Software and/or the Games. All actions in relation to the Software and Games should be personally executed by the User, through the Software.

9. Prohibited Language or Content

The user is prohibited from posting any unlawful, threatening, obscene and defamatory or any other material that would violate any law or is considered dangerous and/or offensive, through the Software’s chat facility, the player images, or in correspondence with RDP staff. Additionally, you are not allowed to post any material that promotes a Product, Software, Site and Games other than Real Deal Poker. Additionally, you are prohibited from making any statements about RDP, the Site, Software and Games, that are untrue, offensive or would be considered as improper by RDP.

You also agree that violation of the above rule will result to the temporary and/or permanent disabling of the chat facility and/or image upload and/or suspension of your account.

10. Authority

Real Deal Poker retains full authority over the issuing, maintenance and closing of Users’ accounts at RDP. The decision of RDP management, regarding any aspect of a User’s account, use of the Software and Games and dispute resolution is final.

11. Limitation of liability

You understand and agree that the use of the Software, Site and Games is at your own risk. Under no circumstances shall RDP be liable for any kind of damages arising out of the use or misuse of the Site, Servers, Software, Games and/or your accessing of the Software, Servers, Site and Games.

12. Disputes

You accept that all historical data regarding each game will be recorded on the RDP Servers. In the event where the cards displayed on your computer are different to the Game records on our Servers, the latter shall prevail. In all disputes in which a ruling, interpretation, clarification or intervention is required, all decisions made by RDP Management are final and binding.

13. Payments

You agree that RDP and/or a payment processing company (one or more) on our behalf, will handle all financial account transactions (referred to herein as "Payment Processor"). You hereby agree that the Payment Processor reserves the right to withhold any payments should the Payment Processor have reason to believe or any suspicion that you may be engaging in or have engaged in fraudulent, unlawful, or improper activity (including collusion).

You agree to fully pay any and all payments due to us or any third party in connection with your use of the Software and Games. You further agree not to make any charge-backs and/or renounce or cancel or otherwise reverse any of your due payments and in any such event you will refund and compensate us for such unpaid payments including any expenses incurred by us in the process of collecting your payment.

The Payment Processor reserves the right to run credit and/or identity checks on a User, with third party credit reference agencies or services, using the information provided to us by a User on registration with the Service. The third party credit reference agencies or services may retain a record of the information but they will not use the information for any other purpose.

14. Security

You agree that you are solely responsible for all use of the Real Deal Software and Games through your Account. In order to access/login to your account via the Software and play the Games and/or make any monetary transactions through your account, you will be required to use a unique User ID and a password. You agree that the User Id and password will remain secret and confidential at all times and that you will take all efforts to protect their secrecy and confidentiality. Any unauthorized use of the Login Credentials shall be the sole responsibility of the User and be deemed as his/her use. Any liability there from shall be that of the User.

15. Breach

Without prejudice to any other rights, you agree that failure to comply with any of the terms and conditions contained herein, we reserve the right to take such action as we see fit, including blocking your access to the Account, Software and Games, terminating your Account, seizing all remaining funds in your Account, and/or taking legal action against you.

16. Amendment

We reserve the right to make amendments to the Agreement at any time, with or without notice. You will be bound by such Agreement as soon as it is posted on the Site. You are advised to visit the site and review the Terms and Conditions of the Agreement on a regular basis. Your continued use of the Site shall be deemed to attest to your agreement to any changes to the Agreement.

17. Governing Law

The construction, validity and performance of this Agreement and any matters relating hereto shall be governed by, and construed in accordance with the laws of the Isle of Man. Each party irrevocably agrees that the relevant courts of the Isle of Man shall have exclusive jurisdiction in relation to any claim, dispute, difference or any other matter arising from or related to this Agreement and irrevocably waives any right that it may have to object to an action being brought in those courts, or to claim that the action has been brought in an inconvenient forum, or that those courts do not have jurisdiction.

18. Severability

If a provision of this Agreement is or becomes illegal, invalid or unenforceable in any jurisdiction, that shall not affect the validity or enforceability in that jurisdiction of any other provision hereof or the validity or enforceability in other jurisdictions of that or any other provision hereof.

19. Assignment

Real Deal Poker reserves the right to assign, sublicense, pledge or transfer this Agreement or any part(s) of the Agreement, at any time without notice. The User may not assign any of his/her rights or obligations under this Agreement.

20. No Deposit Bonus

From time to time REALDEALPOKER may offer no-deposit sign-up bonuses with specific partners. If you have received one then please note that, unless specifically stated otherwise by that specific partner, you must earn a minimum of 350 RealDealPoker Points (RDP) before being able to withdrawal. Please refer to the terms and conditions listed on the site where you received your promotional code for further information. If no information is listed then the terms of withdrawal will remain at 350 RDP’s. If you require any further assistance, please do not hesitate to contact Support at your convenience.
